Request for Ballot Question Assistance – Measures E and G

Dear El Dorado County Residents and rural lifestyle supporters,

No one thought that back in 2014, without any funds, we could gather enough signatures to qualify three initiatives that protect our quality of life in El Dorado County.

Well we did it!  Now two of those Measures will be on the El Dorado County June 2016 Ballot.  Yes on E & G!

Unfortunately the El Dorado County Board of Supervisors has thrown a roadblock in our path.  On February 23, 2016, Chairman Mikulaco denied us our due process to discuss our ballot questions.  The ballot question is the 75-word question that voters read in the ballot.  The Board voted 4-1 to approve the Counsel’s poorly written ballot questions without any discussion.  We felt the ballot questions were so vague and misleading that they would confuse the issues and mislead voters.  

The election process in California requires that the ballot title and question must reflect the character and real purpose of the proposed measure.  (EC § 9105 and Widders v Furchtenicht (2008) 167 Cal.App.4th 769, 781 [interpreting identical provisions for City elections].)

Due to the Board’s denial to allow us to address our concerns regarding the vague, misleading and partisan ballot questions, we are taking this matter to court.
